Contractors need to be aware of new Federal regulations mandating new disclosure requirements

New Federal regulations have been implemented that will impact all contractors doing business with the Federal Government. Effective December 12, 2008, the new regulations impose mandatory disclosure requirements on contractors when they have "credible evidence" of certain violations of criminal law, violations of the civil False Claims Act, or significant overpayments. In addition, a knowing failure to "timely disclose credible evidence" of such violations or overpayments creates a new basis for suspension and debarment. In public statements made December 11, 2008, Government representatives notified the contracting community that they intend to apply these new regulations retroactively, at least with respect to the suspension and debarment provisions.
