Economic Development
OK...my time to chime in on the Kelo v. City of New London, Conn. decision...you remember this one-the decision allowing a governmental body to tear down the homes of its citizens to allow for an upscale development. The big issue is really transfering the asset from one private owner to another....the United States Supreme Court ruled that if a "public purpose" is being achieved as an area was sufficiently economically depressed to be entitled to a face lift, then the public purposes was being served and would allow for the condemnation to go forward.
So does this mean that if we have a "better use" any property, any taking is legitimate? What is the new standard for eminent domain? Surely more cases to follow...........
